FAQ – Colorado Amendment 64

Although recreational marijuana possession and consumption is now legal in Colorado, for those over 21 years of age, please keep in mind that X Games Aspen is an alcohol, drug and smoke-free venue. Also, public consumption of any kind remains illegal.

  1. What will happen if I try to bring marijuana into the X Games?
    You will not be allowed to enter the venue with marijuana, but you will be given the opportunity to take it back to your car/home/hotel. There will also be 4 amnesty boxes outside of the venue where you can dispose of marijuana before entering the venue.
  2. What is Amendment 64?
    The intent of Amendment 64 (Co Const. Art. XVIII Sec. 16) is to treat the use of marijuana like the use of alcohol by adults 21 years old or older. Amendment 64 decriminalizes possession of one ounce or less of marijuana or 6 marijuana plants, only 3 of which may be flowering, and the resulting Marijuana from those plants.   3. How old do you have to be to purchase, possess or consume retail marijuana?
    You must be 21 and older to buy, possess or use retail marijuana.

    • Adults 21 and older are allowed to possess up to 1 ounce of retail marijuana.
    • It is illegal to give or sell retail marijuana to minors.
    • It is illegal to take marijuana across state lines.
  4. Can I consume marijuana in public?
    No, it is illegal to consume marijuana in public.  This includes public and private transportation.
  5. Is Marijuana still illegal under federal law?
    Yes, it remains classified under the Federal Controlled Substances Act as a Schedule 1 narcotic, whose cultivation, distribution, possession and use are still criminal acts under federal law.

    • You cannot possess marijuana on Federal Land including but not limited to national parks, national forests (e.g. Maroon Bells), federal office buildings, courthouses, etc.
  6. Does Amendment 64 require employers to accommodate the lawful use or possession of marijuana?
    No, the law specifically states that employers do not have to accommodate marijuana use or possession at the workplace and also permits employers to enforce policies regarding marijuana use by employees.[2]
  7. Where can I purchase retail marijuana?
    Those 21 and older can purchase retail marijuana at licensed retail stores.
  8. Where am I allowed to consume retail marijuana?
    Retail marijuana is intended for private, personal use. Marijuana may not be consumed openly or publicly. Please contact your Hotel or Rental Management Company with questions.
  9. How much marijuana can I purchase at one time?
    Colorado residents 21 and older can purchase and possess up to 1 ounce of retail marijuana at a time. Non-residents can purchase up to ¼ ounce at a time.
  10. Can I consume marijuana in a licensed retail store?
    No, it is illegal to consume marijuana in or around a licensed store.
  11. What are the consequences if I violate marijuana laws?
    Penalties range from a fine to a possible jail or prison sentence. Please be aware that rules and regulations around legalized marijuana vary from community to community in the state of Colorado.
  12. Are the rules different for possession and consumption of edible marijuana than for marijuana that can be smoked?
    No. Possession laws are the same for all retail marijuana types, and public consumption is always illegal, regardless of form.
  13. Can I have marijuana in my car?
    Yes, but it is illegal to use or consume marijuana in a motor vehicle and it is illegal to drive under the influence of marijuana. Marijuana may be carried in cars but it may not be in an open container.
  14. Is there a DUI-like equivalent for driving under the influence of marijuana? 
    Yes. It is illegal to drive under the influence of marijuana and it can result in a DUI, just like alcohol.
  15. Can I consume / smoke marijuana on my private property like on a balcony or in the backyard?
    Individuals 21 and older can consume marijuana on private property that is not open to the public (Ok places -private homes, your back yard, your properties decks, etc.)
  16. Are there marijuana Smoke Clubs or Coffee Shops in Aspen?
    Currently the City of Aspen has prohibited public and private smoke clubs.
  17. Where can I buy marijuana in Aspen?
    Currently only 1 shop offers retail marijuana, Silverpeak Apothecary. Retail marijuana will not be available until February 2014.
  18. Can I fly with marijuana?
    It is illegal to possess marijuana at Denver International Airport. It is illegal to take marijuana across state lines.
